Cremation/Radiation Issues
NPL 1517(C) requires a signed statement from the authorizing agent that the body does not contain radioactive materials. The Public Health Law states that a crematory may refuse to cremate a body unless accompanied by a statement that any such radioactive materials were removed. The Department of Environmental Conservation, Air Quality Regulation, section 219-4.6 states that radioactive waste may not be burned in a crematory unless that crematory is exempt or has been issued a permit to do so. To the best of our knowledge, no crematories are exempt or have been issued a permit.
